This is an email I received from the Deputy State Fire Marshall on Fire Codes:


The Codes do not have a definition of an "exterior structure", a sign post could be considered and exterior structure. The pergola if it is free standing, not attached to the building, is not covered nor have a roof and is open on at least three sides should not be an issue. If at were attached to the building (or within ten feet of the building) and was covered, it would be considered part of the building and need to meet the requirements of the building which would require sprinkler protection as a minimum and it may not be allowed based on it's construction type.
